INTERNATIONAL TRAINING ON TRANSLATING POLICY INTO LEGISLATION
COURSE BACKGROUND

Across Africa and the Global South, governments and institutions are increasingly formulating progressive and visionary policy frameworks to address urgent issues such as climate change, environmental degradation, energy access, social inequality, and sustainable development. While these policies often represent the collective aspirations of nations and regions, they remain aspirational unless backed by enforceable laws.

The disconnect between policy formulation and legal implementation presents a major hurdle in the effective realization of development goals. In many cases, technically sound policies stall because they are not translated into binding legislation that can be operationalized, funded, monitored, and enforced.

The Environmental Capacities and Sustainability Institute (ECAS) recognizes that bridging this policy-to-law gap is essential for sustainable, inclusive development across Africa. This course, “Translating Policy into Legislation,” is designed in response to the critical need for capacity building among policymakers, legal drafters, civil society actors, and development practitioners.

It provides a structured and practical approach to help stakeholders understand how to move from policy vision to legislative action, ensuring that well-intended policies are not only adopted but also implemented with legal authority. The course demystifies legislative processes, enhances participants’ ability to contribute to and influence lawmaking, and equips them with the tools to draft or review laws that reflect policy goals.

Importantly, the course highlights African case studies, regional policy frameworks (such as the African Union’s Agenda 2063 and the African Climate Policy Centre initiatives), and global agreements (like the Paris Agreement and the Sustainable Development Goals) to ensure participants are prepared to work within both national and international legal landscapes.

By empowering professionals with the ability to effectively convert environmental and development policies into law, ECAS advances its mission of building resilient governance systems and strengthening institutional capacities across the continent.

COURSE OBJECTIVES OF THE TRAINING

By the end of this course, participants will be able to:

  1. Understand the relationship between public policy and legislation.
  2. Navigate the legal and institutional processes for developing and enacting laws.
  3. Translate policy documents into legally sound and enforceable legislation.
  4. Engage stakeholders in participatory and inclusive legislative development.
  5. Align national laws with regional and international frameworks (e.g., SDGs, AU Agenda 2063).
  6. Contribute to more accountable and effective environmental and development governance.

DURATION AND PROGRAM
TARGET PARTICIPANTS

This course is designed for professionals involved in policy development, legal drafting, governance, and sustainable development. Targeted participants include government officials from ministries and agencies responsible for environment, planning, law, and public administration; members of parliament and legislative staff; legal advisors; policy analysts; representatives of civil society organizations; and staff from development agencies and international organizations. It is particularly relevant for those seeking to strengthen the link between policy formulation and legal implementation to support effective, inclusive, and sustainable governance in Africa.

TRAINING STYLE

The modules will be taught through PowerPoint presentations, and lectures and will include a case study/field visit, breakout sessions, case studies and other interactive discussion components.

The course will also include a few guest speakers, both in person and via Zoom and other online learning platforms for overseas speakers. This provides useful real-world insights alongside the more theoretical aspects of the course.

The conference faculty shall consist of experienced decision makers, as well as practitioners and representatives from established educational and research institutions active around climate change, engineering and international development. Throughout the course, theoretical presentation of concepts will be moderated and more group discussions and plenary engagements will be optimized. PowerPoint presentations will be made by facilitators and resource persons, to highlight key concepts before embarking on group work.

1. Understanding the Policy–Legislation Link This module introduces the foundational concepts of policy and legislation, exploring their roles in governance and development. It sets the stage for understanding why and how policies must be translated into law.

2. Legislative Processes and Institutional Pathways This module explores how laws are made, the institutions involved, and the procedural stages from policy intent to enacted law. It also highlights the roles of stakeholders in shaping legislation.

  • Roles of parliament, ministries, and legal drafting offices
  • National, subnational, and regional governance contexts
  • Political economy and institutional challenges in legislation
3. Module 3: Translating Policy into Legal Language Focused on the technical aspects of legal drafting, this module trains participants to convert policy content into structured and enforceable legal provisions.

  • Elements of legislative drafting
  • Writing clear and precise legal clauses
  • Structure of a legal instrument (preamble, definitions, sections)
  • Case studies of successful policy-to-law transitions
4. Stakeholder Engagement and Participatory Lawmaking Effective legislation requires public legitimacy and buy-in. This module emphasizes participatory approaches, inclusive consultations, and stakeholder analysis in the drafting process.

Aligning National Laws with Regional and Global Frameworks This module focuses on ensuring that national legislation aligns with Africa’s regional priorities and international commitments, such as the SDGs, AU Agenda 2063, and climate agreements.

6. Legislative Advocacy and Policy Influence Policy-to-law transitions often require strategic advocacy. This module equips participants with tools for influencing the legislative agenda and building coalitions for reform.

7. Simulation and Practical Exercises This hands-on module reinforces learning through simulations and real-life application. Participants draft a sample bill from a policy document and take part in a mock legislative debate.
